3. The NCT Attitude

The introduction  of Case Tracking software in the Land Registry some years ago enabled the performance of solicitors to be compared.  It was found that:

·        A few firms had Zero or Very Few queries;

·        A few firms had almost 100% of cases queried;

·        Most received queries on a proportion of cases.

The difference between the performance of the top firms and the bottom firms can be explained by attitude.

The top firms took responsibility for their work and got it right first time by ensuring that all necessary proofs were submitted with the application.

The worst firms took the attitude that they could save time and effort, on their part, by letting  the Land Registry specify the requirements for the registration.

I call this the NCT attitude, since it is comparable to the attitude of some motorists to the National Car Test.  When the test came in first, motorists made sure that their vehicle was in good shape before submitting.  Now a lot of motorists don’t bother having their vehicle serviced before submission to the test, in the expectation that the NCT will specify all defects that require attention, which they then attend to and resubmit.
